Napoles asks Supreme Court to allow bail anew

Metro Manila (CNN Philippines, February 23) — Businesswoman Janet Lim Napoles is once again asking the Supreme Court to grant her bail in plunder cases she is facing over an alleged pork barrel scam.

In a motion dated February 13, Napoles invoked the main plunderer doctrine, a concept first introduced in the high court ruling acquitting former president Gloria Macapagal-Arroyo of plunder.

The Supreme Court then said for a crime to be considered plunder, the main plunderer should be identified and also the principal role the accused played in the alleged offense.

In her motion, Napoles argued the Ombudsman failed to establish that she is the main plunderer or principal mastermind in the alleged pork barrel scam.

This is the first time she is invoking the doctrine, which was cited as the legal basis for her co-accused Senator Jinggoy Estrada to post bail.

She faces several plunder and graft charges before Sandiganbayan divisions for alleged involvement in a ₱P10-billion pork barrel scam.

Napoles allegedly conspired with about 12 former lawmakers to divert public funds to her bogus NGOs. Apart from Estrada, former senators Juan Ponce Enrile and Bong Revilla were also tagged.

Enrile was allowed to post bail by the high court on humanitarian grounds.

Napoles' petitions for bail were denied at the Sandiganbayan. She also previously asked the high court to set aside Sandiganbayan rulings denying her bail, but those appeals have been denied.

In December, Napoles' daughter Jeane was let off the hook for allegedly being unable to pay ₱P17 million in taxes. She was also accused of owning a ₱54.73 million upscale Ritz Carlton condominium unit in Los Angeles, California, as well as a farm in Bayambang, Pangasinan.
